First of all, we're sorry you're going through this. Divorce is hard enough on its own, and we're sorry about whatever circumstances brought you to this point, but we want to be a resource for you.

Here's what we've uncovered on how to properly sell a mobile home while going through a divorce in Oregon. Hopefully, this can be something that takes away stress in your life rather than adding to it. At the end of the day, that's our goal: to make this as easy as possible for you.

A note before we begin

While I graduated law school and passed the bar exam in New York, I am not a licensed attorney, and nothing here is legal advice. Treat this as a general guide to how the title process typically works, and check with your own attorney before making any decisions based on it.

There Are Three Paths, and Only One Applies to You

When a divorce involves a mobile home, what happens to the title depends entirely on one thing: whose name was on it to begin with, and what the court order says. There are three possible paths, and you'll need to follow the one that matches your situation. Below, each situation includes the specific state forms involved, along with a sample of what the ownership document looks like in that scenario.

Situation 1

Both Spouses Are on Title

If both spouses are listed as owners on the manufactured home's ownership document and the court order awards the home to one of you, the title needs to be updated to remove the other spouse.

To do that, the spouse being awarded the home files Form 5221 (Affidavit in Support of Change to a Manufactured Home) with the divorce box checked.

This is a sworn statement: you're attesting that the court order awarded you the home, and providing the case number. It has to be notarized, but you don't need to submit the court order itself. You just attest that you have it. If you're awarded the home, the court order should say something like this:

In addition, you'll need to file Form 2952 (Ownership Document Application).

  1. Complete Form 5221 (divorce box checked, notarized) and Form 2952.
  2. Take both forms to the county tax assessor's office and ask for a paid tax certification.
  3. Post the filing fee, and you're done!
Situation 2

Only One Spouse Is on Title, and That Spouse Is Awarded the Home

No forms needed

This is the most straightforward path. If only one spouse was ever on the title, and the court order confirms that same spouse keeps the home, there's nothing to file. The ownership document already reflects reality, so no forms are needed at all.

Situation 3

Only One Spouse Is on Title, but the Home Goes to the Other Spouse

This is the situation people are least prepared for. Even if only one spouse's name is on the title, Oregon courts can still award the home to the other spouse as part of the divorce. Title alone doesn't determine who's entitled to the home in a divorce settlement.

When that happens, the title has to transfer to someone with no prior ownership record at all. This uses the same Form 5221 affidavit as Situation 1 above, with the divorce box checked, and it's submitted alongside Form 2952 to establish an entirely new owner of record, not simply remove one. It's a slightly bigger lift than the first two situations, and it's worth having an experienced hand walk you through it.
